Bazil Oglinda a prezentat la cea de-a patra editie a Business Law Conference doua lucrari de specialitate vizand dreptul contractual roman si influenta sistemelor straine de drept asupra celui autohton. Daca in articolul intitulat “Principiul utilizarii progresive (graduale) a remediilor contractuale”, autorul justifica necesitatea unei conduite prin care creditorul nesatisfacut sa aplice progresiv remedii, in articolul intitulat “Modificarea clauzelor prin comportamentul contractual al parților. Aplicație a doctrinei Estoppel” analiza viza care parte este indreptatita sa aiba castig de cauza intr-un litigiu, cea care se bazeaza pe clauza contractuala sau cea care se bazeaza pe comportamentul comun si ulterior al partilor, împotriva clauzei contractuale?

Romanian contractual law and the influence of foreign law systems on the domestic one have been the key topics of the research papers presented by Bazil Oglinda at the fourth edition of Business Law Conference. While in the former paper “The principle of using progressive (gradual) contractual remedies” the author argues that unsettled creditors should apply progressive remedies (instead of radical ones) to settle matters, in the article “Changing terms upon the contractual behavior of the parties. Application of the Estoppel doctrine” the author analyzes witch side is entitled to winning in a litigation: the one that builds its arguments on the contractual clause or the one that relies on the joint, subsequent behavior of the parties, against the contractual clause?
